This website is operated by Mystic Medicine Woman. Throughout the site, the terms “I”, “we”, “us” and “our” refer to Mystic Medicine Woman. Mystic Medicine Woman offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our website and/or purchasing something from us, you engage in our “service” and agree to be bound by the following terms and conditions (“terms of tervice”, “terms”). These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

1. General
1.1 These general terms and conditions apply to all offers, orders, and agreements made through the webshop Mystic Medicine Woman.
1.2 By placing an order, the customer confirms that they have read these terms and agree to their contents.
1.3 Deviations from these terms are only valid if confirmed in writing by the webshop.
1.4 The webshop reserves the right to amend these general terms and conditions.
1.5 Amended terms apply to all new orders, unless otherwise agreed.

2. Offers and agreements
2.1 All offers in the webshop are non-binding and can be changed at any time.
2.2 An agreement is only established after the webshop has confirmed the order in writing or has dispatched the order.
2.3 The webshop has the right to refuse orders or request additional information before concluding the agreement.

3. Prices
3.1 All listed prices are in euros and include VAT, unless stated otherwise.
3.2 Shipping costs are not included in the price and will be separately indicated during the ordering process.
3.3 The webshop reserves the right to change prices. The prices applicable at the time of ordering are binding.
3.4 If it appears after concluding the agreement that the price has changed due to incorrect information, the webshop has the right to inform the customer and give them the option to cancel the order or accept the revised price.

4. Payment
4.1 Payment can be made via the payment methods offered in the webshop.
4.2 Payment must be made during the ordering process. The webshop has the right to dispatch products only after the due amount has been paid.
4.3 The customer is obligated to pay the due amount within the stipulated period. In the event of late payment, the customer is in default.
4.4 In the event of default, the webshop reserves the right to charge interest and collection costs or to terminate the agreement and refuse delivery.

5. Delivery
5.1 Delivery takes place at the address provided by the customer.
5.2 If incorrect address details are provided by the customer, the webshop is not responsible for incorrect shipping or loss of the order. In the case of incorrectly entered addresses, no claim can be made for a refund of the purchase amount or for free reshipping of the products.
5.3 The webshop aims for a delivery time of 7 working days, unless stated otherwise. Delivery times are indicative and may vary.
5.4 If delivery is delayed, the customer will be notified as soon as possible. The webshop is not liable for delays caused by third parties or force majeure.
5.5 Upon delivery, the customer is obliged to immediately check the received goods for any defects or inaccuracies.

6. Right of withdrawal
6.1 The customer has the right to withdraw from the agreement within 14 days after receipt of the products without giving any reason.
6.2 The customer must notify the webshop of the return request within this period via email (themysticmedicinewoman@gmail.com) and return the products in their original condition and packaging.
6.3 The costs of the return shipment are the customer's responsibility unless otherwise agreed. The webshop will reimburse the return shipping costs if the delivered products do not comply with the agreement.
6.4 If the webshop has granted approval for the return request, the customer must send the products back carefully. It is the customer's responsibility to ensure that the products arrive safely. If a product arrives damaged, no claim can be made for a refund of the purchase amount or for free reshipping of the products.
6.5 After receipt and inspection of the returned products, the webshop will refund the purchase amount within 14 working days. This does not apply to shipping costs of the original shipment.

7. Exceptions to the right of withdrawal
7.1 Cacao and (tea) herbs, including complete ceremony packages, cannot be returned for hygienic reasons. This is a product with a limited shelf life.
7.2 Candles are not accepted as returns because they are made only after the product is ordered.
7.3 Digital products are not subject to the right of withdrawal.
7.4 Customized products cannot be returned.

8. Warranty and complaints
8.1 The webshop offers legal warranty on the delivered products, which means that the products meet the reasonable expectations that the customer may have.
8.2 Complaints about the delivered products must be reported within 48 hours of receipt via email.
8.3 If a complaint is justified, the customer is entitled to a refund of the purchase amount. The webshop will inform the customer of the solution within 14 working days after receipt of the complaint.

9. Liability
9.1 The webshop is not liable for indirect damage, including consequential damage, lost profits, or damage due to loss of data.
9.2 The liability of the webshop is limited to the amount that is paid out by the insurance in the relevant case.
9.3 The webshop is not liable for damage caused by incorrect or incomplete information provided by the customer or by the use of the delivered products.

10. Privacy
10.1 The webshop respects the customer's privacy and processes personal data in accordance with the General Data Protection Regulation (GDPR).
10.2 Personal data will only be used for the execution of the agreement and will not be disclosed to third parties without the customer's consent, unless necessary for the execution of the agreement.
10.3 For more information on the processing of personal data, we refer to our privacy policy, which is available on the website.

11. Intellectual property
11.1 All intellectual property rights on the website and the products offered are held by the webshop or its licensors.
11.2 The customer is not permitted to reproduce, distribute, or make public the content of the website, including texts, images, and other materials, without prior written consent from the webshop.

12. Applicable law and disputes
12.1 These general terms and conditions and all agreements are governed by Dutch law.
12.2 Disputes arising from or related to these terms or the agreement will be submitted to the competent court in the Netherlands.

14. Terms and Conditions of De Coöperatie Scope U.A.
14.1 I operate under De Coöperatie Scope U.A. The general terms and conditions of Scope also apply to my webshop, in addition to the terms described on this page. These general terms and conditions are as follows:

General Terms and Conditions for Services and Products of De Coöperatie Scope U.A., KvK no. 69002045, hereinafter referred to as Coöperatie U.A.

1. General
These general terms and conditions apply to all offers, activities, quotations, and agreements for professional services between Coöperatie U.A. and clients unless otherwise agreed upon in writing. By entering into an agreement, the client acknowledges having read and accepted these general terms and conditions as the sole supplement to the agreement.

2. Quotations
Quotations from Coöperatie U.A. are based on the information provided by the client. The client guarantees that they have provided all essential information for the setup and execution of the assignment to the best of their knowledge. Coöperatie U.A. will perform the services to be provided to the best of its ability and in accordance with the standards of good workmanship.
Offers made by Coöperatie U.A. are valid for two months unless stated otherwise in the offer. As long as the offer has not resulted in an assignment, Coöperatie U.A. reserves the right to allocate its resources elsewhere.

3. Provision of Information and Employees by the Client
To ensure the proper and timely execution of the assignment, the client shall provide all documents and data required by Coöperatie U.A. promptly. This also applies to making employees from the client’s organization available who will be involved in the tasks carried out by Coöperatie U.A.
The involvement or engagement of third parties in the execution of the assignment by the client or Coöperatie U.A. will only occur in mutual consultation.

4. Staff
Coöperatie U.A. may, after notifying the client, change the staffing of the assignment or engage third parties if it deems this necessary for the execution of the assignment. Such changes must not diminish the quality of the services provided or adversely affect the continuity of the assignment. Staffing changes may also occur at the client’s request, in consultation with Coöperatie U.A.

5. Rates, Costs, and Payment Terms
The rates and corresponding cost estimates are stated in the quotation or on the website. Reproduction costs, travel hours, travel and accommodation expenses, and other assignment-related costs are included unless specified otherwise in the quotation.
VAT will be charged separately on all amounts owed by the client to Coöperatie U.A.
Fees and costs are invoiced upon completion of the assignment or monthly (in arrears), unless otherwise agreed. Payment must be made within two weeks of the invoice date. If the client does not pay within xx weeks of the invoice date, they are considered in default by law without the need for any formal notice, and statutory interest may be charged.
If payment is not made, Coöperatie U.A. may suspend the execution of the assignment. If the client defaults or otherwise fails to meet one or more of their obligations, all reasonable costs incurred to obtain payment shall be borne by the client.

6. Modification of the Assignment or Additional Work
The client acknowledges that the schedule for the assignment may be affected if the parties agree to expand or modify the approach, scope, and/or resulting tasks during the assignment. If the interim changes affect the agreed fees or expense reimbursements, Coöperatie U.A. will consult with the client.

7. Duration and Completion of the Assignment
The duration of the assignment may be influenced by various factors, such as the quality of the information provided to Coöperatie U.A. and the cooperation extended. Any schedule provided by Coöperatie U.A. is therefore only an indication. If the client does not respond within thirty days of receiving the final (closing) invoice, the final account will be deemed approved, and the assignment concluded.

8. Early Termination of the Assignment
If the client fails to fulfill their obligations under the agreement(s), Coöperatie U.A. is entitled to terminate the agreement, without prejudice to its right to claim damages. Additionally, either party may terminate the agreement prematurely if they believe the execution of the assignment can no longer proceed according to the confirmed quotation and any subsequent additional specifications. This must be communicated in writing and with justification, with a notice period of 14 days. For assignments involving more than 20 hours per week, a notice period of at least 1 month applies.
Coöperatie U.A. remains entitled to payment for work performed up to that point, and preliminary results of work completed up to then will be provided to the client, under reservation. Any additional costs incurred will be charged. If either party is declared bankrupt, applies for suspension of payment, or ceases operations, the other party has the right to terminate the assignment with immediate effect, without prejudice to other rights.

9. Intellectual Property
Models, techniques, tools, including software, used in the execution of the assignments and included in the advice or research results, remain the property of Coöperatie U.A. Publication is only allowed with the prior consent of Coöperatie U.A. The client has the right to reproduce documents for use within their own organization, provided it aligns with the purpose of the assignment. In the event of early termination, the above also applies.

10. Confidentiality
Coöperatie U.A. is obligated to maintain the confidentiality of all client information and data towards third parties. Coöperatie U.A. will take all necessary precautions to protect the client’s interests in the context of the assignment.
Without the consent of Coöperatie U.A., the client shall not disclose any information about Coöperatie U.A.'s approach, methods, or reports to third parties.

11. Liability
Coöperatie U.A. is only liable for shortcomings in the execution of the assignment or delivered products if these are due to deliberate intent or gross negligence by Coöperatie U.A. This liability is limited to the amount invoiced over the last 12 months. Liability for indirect or consequential damages is excluded.
The liability ceases entirely if the client uses the product or advice delivered by Coöperatie U.A. in a way not prescribed or advised, or if changes are made by the client.

12. Applicable Law
The agreement(s) between the client and Coöperatie U.A. are exclusively governed by Dutch law. Disputes will be submitted to a competent court.
